Today EPA proposed two new rules to enforce and implement its new GHG Tailoring Rule. With some states stridently protesting the Tailoring Rule, these new rules will allow EPA to step in and take over facility permitting by establishing a federal permitting program. EPA identified 13 states that need to make changes to their state implementation programs....

Breaking News: EPA Sued by Center for Biological Diversity To Force Regulation Of Up To 6 Million GHG Sources -
In what is expected to be a landmark federal court case on climate, today the advocacy group Center for Biological Diversity (CBD) filed suit against the U.S. EPA over its GHG "tailoring rule." CBD, which has a successful track record on federal GHG law suits, is asking the federal courts to review EPA's implementation of their new rule under the Clean Air Act -- an action that could result in federal courts requiring the agency to regulate GHG-emitting sources emitting as little as 100 tons per year. This week EPA released a redrafted 2005 Clean Air Interstate Rule (CAIR) which plans to reduce emissions from power plants in the eastern U.S by as much a 71% for SO2 and 52% for NOx emissions below 2005 levels by 2014. With EPA’s recently released greenhouse gas tailoring rule, its forthcoming mercury MACT rule, and expected litigation, a large number of coal fired power plants are expected to shut down in the next few years. A new study estimates the costs could be as high as $750 billion....
